A California woman who got ticketed for wearing Google Glass while driving said Thursday she plans to fight the ticket.

Cecilia Abadie was pulled over by California Highway Patrol for going 80mph in a 65mph zone on Tuesday, but when officers spotted her wearing Google’s Internet-enabled glasses, she was given a ticket for distracted driving. Abadie said her Google Glass, which costs about $1,500, wasn’t in active use when she was pulled over, so she wasn’t driving distracted, the Associated Press reports.

She also said using Google Glass shouldn’t be considered distracted driving since it stops drivers from glancing down at their phones.

“Maybe Glass is more a solution to the cellphone problem than a problem,” Abadie told the AP.

Only about 10,000 Google Glass units have been distributed since their launch last spring. Abadie, who is a software developer, got hers in May. Google announced plans to make 30,000 more available.

California Highway Patrol Officer Marc Hale disagreed with Abadie, “Anything that takes your attention away from the motoring public in front of you is a distraction,” he said.
