(PHOENIX) — Jurors who spent five months determining Jodi Arias’ fate couldn’t decide whether she should get life in prison or die for murdering her boyfriend, sending prosecutors back to the drawing board to rehash the shocking case of sex, lies and violence to another 12 people. Judge Sherry Stephens gave a heavy sigh as she announced a mistrial in the penalty phase of the case Thursday and scheduled a July 18 retrial. “This was not your typical trial,” she told jurors. “You were asked to perform some very difficult duties.” The panel then filed out of the courtroom after 13 hours of deliberation that spanned three days, with one female juror turning to the victim’s family and mouthing, “Sorry.” She and two other women on the jury were crying. None of the jurors commented as they left court. The mistrial set the stage for a whole new proceeding to determine whether the 32-year-old former waitress should get a life sentence or the death penalty for murdering Travis Alexander five years ago. He was shot and stabbed nearly 30 times — his throat slit ear to ear — in what prosecutors said was a jealous rage because he wanted to date other people. A new jury will be seated to try again to reach a decision on Arias’ sentence — unless the prosecutor takes execution off the table and agrees to a life term. Jury selection for the next phase could take weeks, given the difficulty of seating an impartial jury in a death penalty case that has attracted global attention. (MORE: 5 Bizarre Revelations from the Jodi Arias Trial) Arias, who first said she wanted to die and later pleaded to the jury for her life, looked visibly upset about the mistrial and sobbed before it was announced. Her family didn’t attend Thursday but has been present for much of the trial. Family members of Alexander also cried in court. The same jury on May 8 found Arias guilty of first-degree murder in the death of Alexander, who was nearly

(SPOKANE, Wash.) — The FBI says a 37-year-old man has been arrested following last week’s discovery in Washington state of a pair of letters containing the deadly poison ricin. Matthew Ryan Buquet was expected to make his initial appearance in federal court in Spokane following his arrest Wednesday afternoon. The letters were postmarked in Spokane and addressed to the downtown post office and the adjacent federal building. They were intercepted by the Postal Service, and no one was injured. Investigators in hazardous materials suits spent most of Saturday executing a search warrant at a three-story apartment building downtown but said there was no public health risk.
(PHOENIX) — In a surprise jailhouse interview just hours after a jury began deliberating her fate, Jodi Arias spoke out Tuesday about her murder trial, her many fights with her legal team and her belief that she “deserves a second chance at freedom someday.” Arias spoke to The Associated Press as part of a series of interviews with media outlets. She repeated many of her claims from previous interviews, testimony on the witness stand and her statements to the jury earlier Tuesday as she pleaded for mercy. But she provided some new information about her case and how she believed her lawyers let her down by not calling more witnesses who could have bolstered her claims that she was a victim of domestic violence at the hands of Travis Alexander. Arias was convicted last week of first-degree murder in the June 2008 stabbing and shooting death of her one-time lover in what prosecutors described as a cold, calculated killing carried out in a jealous rage. Arias has maintained all along it was self-defense. The jury began deliberating her fate Tuesday as they worked to determine whether she should be live or die for her crime. If the jury opts for a life sentence, the judge will have the option of determining whether she spends the rest of her days behind bars or is eligible for release after 25 years. Arias acknowledged it was unlikely she would ever be released, but believed she deserves a second chance. Following her conviction, she said she preferred the death penalty in an interview with a local TV station last week. She said she changed her mind after a tearful meeting with family members that same day, realizing that her death would only cause them more pain. “I felt like by asking for death, it’s like asking for assisted suicide and I didn’t want to do that to my family,” she told the AP Tuesday night. Arias said she fought from the beginning to keep cameras out of the courtroom to limit the media spectacle,

(DES MOINES, Iowa) — A 15-year-old central Iowa girl who was abducted after getting off her school bus was still missing Tuesday, and authorities said a massive search was underway. Meanwhile, the Iowa Division of Criminal Investigation said the man who is suspected of taking her and another girl committed suicide. Dozens of federal, state and local law enforcement officials are searching by air, land and water for Kathlynn Shepard. She and a 12-year-old girl, who are friends, were taken Monday afternoon shortly after stepping off a school bus in Dayton, about 60 miles north of Des Moines. The younger girl, who was later able to escape, told authorities the girls had accepted a ride from a stranger. DCI Special Agent Bill Kietzman said Tuesday that the body of 42-year-old suspect Michael Klunder was found Monday night with a red Toyota Tundra pickup at a rural property northeast of Dayton. Kietzman said authorities have begun focusing their search for Kathlynn on a 20-mile radius around Dayton. Previously, the search covered up to 100 square miles of mostly rural areas. Authorities have also coordinated with the FBI to update electronic billboards around the state with information about the search. Kietzman would not elaborate on the likelihood of finding Kathlynn alive, though he remained optimistic. “Time obviously is not your friend in these kinds of situations,” he said at a news conference. “Our plan is that we’re going to find her alive. That’s our hope.” The 12-year-old girl, who has not been identified, told investigators she and Kathlynn were taken to an agricultural facility. But she was able to escape a short time later and ran to a rural residence for help, Kietzman said. She was then taken to a Fort Dodge hospital and released. The abduction spanned several hours, officials said, with Klunder’s body being discovered nearly four hours after the girls were taken. Kathlynn is described as being 5-feet-6-inches and 160 pounds. She has blond hair, blue eyes and braces. She was last seen wearing jeans, a gray hooded sweatshirt

PHOENIX (AP) — Jodi Arias begged jurors Tuesday to give her life in prison, saying she “lacked perspective” when she told a local reporter in an interview that she preferred execution to spending the rest of her days in jail. Standing confidently but at times her voice breaking, Arias told the same eight men and four women who found her guilty of murdering her one-time boyfriend that she planned to use her time in prison to bring about positive changes, including donating her hair to be made into wigs for cancer victims, helping establish prison recycling programs and designing T-shirts to raise money for domestic abuse victims. She also said she could run book clubs and teach classes to prisoners to “stimulate conversations of a higher nature.” Later Tuesday, Arias continued her campaign when Judge Sherry Stephens allowed Maricopa County Sheriff Joe Arpaio’s office to set up media interviews. Within minutes, Arias agreed to talk to several media outlets while in jail, even while the jury deliberates her fate. The Associated Press was among those scheduled to talk to her. Arias became emotional as she displayed for jurors photos of her friends, boyfriends and family members, including newborn relatives she has met only from behind bars. She pleaded with jurors to reject the death penalty for the sake of her family. (MORE: 5 Bizarre Revelations from the Jodi Arias Trial) “I’m asking you to please, please don’t do that to them. I’ve already hurt them so badly, along with so many other people,” she said. “I want everyone’s healing to begin, and I want everyone’s pain to stop.” Arias admitted killing Travis Alexander and said it was the “worst thing” she had ever done. But she stuck to her story that the brutal attack — which included stabbing and slashing Alexander nearly 30 times, shooting him in the head and nearly decapitating him — was her defense against abuse. “To this day, I can hardly believe I was capable of such violence. But I know that I was,” she said. “And

(MINEOLA, N.Y.) — As a grieving family prepared for the funeral of a Hofstra University junior killed by a police officer’s bullet during a standoff with an armed intruder, some on Monday questioned whether police should have waited for help, including a hostage negotiating team. “I think the police is not very professional,” the dead woman’s godfather said outside the family home in Westchester County, north of New York City. “If he’s professional, he should have tried negotiation,” Henrique Santos said. Santos earlier told the Journal-News: “He should have hit the guy with the first shot, not eight.” A key question is whether the officers responding to the house near the Hofstra campus at 2:30 a.m. Friday were aware the intruder was holding hostages. Police officials described the initial report as simply a robbery in progress. One of the two officers who entered the home found the intruder holding 21-year-old Andrea Rebello in a headlock and “kept saying ‘I’m going to kill her,’ and then he pointed the gun at the police officer,” said Nassau County homicide squad Lt. John Azzata. That’s when the officer, who has not been identified, fired eight times, fatally striking 30-year-old Dalton Smith with seven shots and Rebello with one shot to the head. Smith, who had a 9 mm pistol, never fired a shot, police said. Edward Mamet, who spent 40 years as a New York City police officer and appears as an expert witness on police procedure, said if the responding officers knew hostages were inside the house, they should have taken a cautious approach and waited for backup. “Unless it’s clearly indicated that the lives of hostages and any bystanders are in jeopardy,” Mamet said. “If that’s the case, then everything goes out the window.” Police Commissioner Thomas Dale said the criminal investigation is ongoing and an internal police department investigation will follow. A spokesman for the district attorney’s office said Monday it also was monitoring the police investigation.
(PHOENIX) — When Jodi Arias addresses the jury in her murder trial one more time, the big question will be whether she pleads for mercy or repeats what she told a TV reporter minutes after her conviction: She would rather be executed than spend the rest of her life in prison. After nearly five months of testimony in a case that has captured tabloid headlines with tales of sex, lies and violence, Arias’ final words to the jury will soon bring the trial to an end. Arias’ own attorneys tried to quit the case and asked for a mistrial a day earlier after complaining the trial had become a witch hunt. But the judge swiftly rejected the requests. The defense then said they would call just one witness to testify — Arias herself. She is set to speak to the jury Tuesday morning. After closing arguments, the jury will begin deliberations and decide whether Arias should be sentenced to life in prison or face the ultimate punishment for the June 2008 shooting and stabbing death of boyfriend Travis Alexander in his suburban Phoenix home. Arias initially claimed she knew nothing about the slaying. Then she blamed masked intruders before eventually settling on self-defense. Prosecutors argued she killed Alexander in a jealous rage because he wanted to end their relationship and go to Mexico with another woman. The 32-year-old former waitress spent 18 days on the witness stand during the guilt phase of her trial, describing an abusive childhood, cheating boyfriends, dead-end jobs, a shocking sexual relationship with Alexander, and her contention that he had grown physically violent. Jurors didn’t believe her then, and experts say they likely will show no mercy now. The victim suffered nearly 30 knife wounds, his throat was slit from ear to ear, and he was shot in the forehead. Arias then dragged him into his shower, where his decomposed body was found days later. “I think they could put Mother Teresa on there, and it’s not going to spare her life,” said Phoenix defense attorney

(PHOENIX) — Jodi Arias’ lawyers have asked to withdraw from the case and say they won’t call any witnesses in the penalty phase of her trial. The stunning declaration came Monday after the judge denied their request for a mistrial based on a key witness receiving death threats. In protest to the judge’s decision, defense lawyers Kirk Nurmi and Jennifer Willmott asked to withdraw. Their request was promptly denied. The attorneys then said they won’t call any witnesses to testify on Arias’ behalf as jurors consider a life or death sentence, sending the court into recess as lawyers work to resolve the next step. Arias and an ex-boyfriend had been expected to speak to jurors before the panel begins deliberating whether to sentence the 32-year-old Arias to life in prison or execution for murdering her lover in 2008.
(MINEOLA, N.Y.) — In what police are describing as a crime of opportunity, a wanted man with a criminal history dating nearly 15 years entered a front door that had been left open at a New York home near Hofstra University. A short time later, the intruder, Dalton Smith, and a 21-year-old college junior, Andrea Rebello, were both dead. The two were killed early Friday by a Nassau County police officer who fired eight shots at the masked man, hitting him seven times but also accidentally hitting Rebello once in the head, Nassau County homicide squad Lt. John Azzata said Saturday. Smith was holding Rebello in a headlock and pointing a gun at her head before he turned his gun at the officer, Azzata said, prompting the shooting. “He kept saying, ‘I’m going to kill her,’ and then he pointed the gun at the police officer,” Azzata said. A loaded 9 mm handgun with a serial number scratched off was found at the scene, police said. Nassau County Police Commissioner Thomas Dale said he had traveled to Rebello’s Tarrytown, N.Y., home to explain to Rebello’s parents what happened. “I felt obligated as a police commissioner and as a parent to inform them as soon as all the forensic results were completed,” Dale said. The veteran police officer, who was not identified, has about 12 years of experience on the Nassau County police force and previously spent several years as a New York City police officer, Dale said. The officer is currently out on sick leave. He will be the focus of an internal police investigation once the criminal investigation is completed, which is standard police procedure in any officer-involved shooting, the commissioner said. The shooting came just days before the school’s commencement ceremonies, which are scheduled for Sunday. A university spokeswoman said students will be handed white ribbons to wear in memory of Rebello. The shooting, which took place just steps from campus, has cast a pall over the university community as it geared up for commencement. Earlier Saturday, police

(NEW YORK) — A gunman used homophobic slurs before firing a fatal shot point-blank into a man’s face on a Manhattan street alive with a weekend midnight crowd, a killing New York’s police commissioner called an “anti-gay” hate crime. Before opening fire early Saturday, the gunman confronted the victim and his companion in Greenwich Village and asked if they “want to die here,” Police Commissioner Raymond Kelly said. The shooting follows a series of recent bias attacks on gay men in New York, but this was the first deadly one. About 15 minutes before the bloodshed, the gunman was seen urinating outside an upscale restaurant a few blocks from the Stonewall Inn, a birthplace of the gay rights movement, according to Kelly. He then went inside the restaurant and asked if someone was going to call the police about him. Police said the gunman, identified later as 33-year-old Elliot Morales, told both the bartender and the manager, “if you do call the police, I’ll shoot you” and opened his sweatshirt to reveal a shoulder holster with a revolver and made anti-gay remarks, Kelly said. Morales has a previous arrest for attempted murder in 1998, police said. Details of that arrest weren’t immediately clear. Out on the street minutes later, the gunman and two others approached the 32-year-old victim, identified by police as Harlem resident Marc Carson, and a companion on Sixth Avenue. One of the three men yelled out, “What are you, gay wrestlers?” according to Kelly. The two men stopped, turned and, according to Kelly, said to the group taunting them, “What did you say?” — then kept walking. “There were no words that would aggravate the situation spoken by the victims here,” the commissioner said. “This fully looks to be a hate crime, a bias crime.” Two of the men kept following the victim and his companion, Kelly said, adding that witnesses saw the pair approach from behind while repeating anti-gay slurs. The gunman asked the men if they were together and when he got an affirmative answer,
