Florida Man Convicted Of Attempted Murder In Loud Music Shooting

Mistrial declared on first degree murder charge in Michael Dunn's slaying of Jordan Davis

A Florida jury convicted 47-year-old software developer Michael Dunn of attempted murder for shooting into a carful of black teens on Saturday, but the jurors could not reach a verdict on the most serious charge of first degree murder. 

Jurors spent over 30 hours deliberating on Dunn’s high-profile case, but could only agree on a verdict finding him guilty of three counts of attempted second-degree murder and one count of firing into an occupied car. A mistrial was declared on the murder charge Dunn faced in the fatal shooting of 17-year-old Jordan Davis. But Dunn will still likely spend decades behind bars; each count carries a mandatory minimum 20-year sentence, to be carried out consecutively.

The fatal shooting occurred in 2012 after Dunn confronted Davis about loud music coming from his SUV. Dunn, who had a concealed weapons permit, claimed he fired in self-defense after seeing a firearm pointed at him from the SUV, shooting 10 times at the vehicle where three of Davis’ friends were also sitting. No weapon was found in the SUV. Prosecutors said Dunn shot because he felt disrespected by Davis.

The case has been compared to the George Zimmerman murder trial, as both raise thorny questions about race and self-defense in a state with stand your ground laws; Michael Dunn was white while the teens were black. The jury’s partial verdict comes just six months after Zimmerman was acquitted on all charges.

It is not the loud music, but the intensely amplified base reverberation in modern audio that causes  temporary insanity.

Loud thumping low frequency rhythms can be used to manipulate people into insanity.

I am frequently surprised that intense low frequency rhythms squeezes intense inexplicable and violent emotions out of me, which I normally could never experience. The reverberation makes me feel extreme anger at nothing. Every time a car playing loud reverberative sounds, I get extremely angry at nothing. After the car passes, I would not be able to reproduce that anger.


I have also read that the USSR used to beam low frequency audio at the US embassy in moscow.

Personally I consider "loud music" to be an assault of sound waves. It's an assault on me, those in my vehicle, and the vehicle itself. Many, many times, I have considered doing exactly what this individual did. And the fact that it does not happen more often is testament to not only our tolerance but also our emotional stability. Honestly I'm not happy with the prosecution of this case because in my opinion this guy is going to do far more time than he deserves.

This guy is a three time loser. Divorced, estranged from his own son, gets hammered at a wedding reception, has a bad attitude, shoots because music is too loud, could have driven away, shoots at a fleeing car, doesn't report the shooting, does home, eats a pizza, orders a movie, takes a shower, relaxes like nothing happened and it's all good. Hope he get 60 years with having to serve 85% of that time, making him 98 before he's eligible for parole. Enjoy prison, you loser.

People are edgy.  When we learn about Mall shootings, school shootings and incidents like this one we, as a nation, are feeling vulnerable.  Look at a gansta kinda guy wrong and you'll end up in a confrontation that could end your life.  Walk into a movie theater and you may not feel all that safe.  The remarkably senseless violence and attacks on us everywhere we go is having its effect.  So, I can certainly understand how Dunn may have felt in the presence of loud teens playing their loud music. 

Let's also understand that the kids in the SUV weren't innocent.  They promoted an environment and probably acted in a manner that would be construed as intimidating.  Does anyone think that there were polite "yes sir's" or "no sir's" by them when asked to turn down the volume?  I'm sure their reaction was aggressive, arrogant and belligerent.  Not a positive way to defuse a tense situation.  They, more than likely, set their own stage and exposed themselves to a possible confrontation they arrogantly thought wasn't going to happen.   

With that said very little suggests that the kids would have actually become physical with Dunn.  But Dunn had a carry permit and was in possession of a fire arm.  And he was feeling vulnerable.  But, when one is equipped with a hammer every confrontation looks like a nail.  And, he probably not only over reacted but over did any reasonable response to the perceived threat.  I think he was scared and didn't maintain his own sense of reason.

Of course I'm comfortable and safe at my computer desk.  I can present this or that idea and opinion.  But, I simply wasn't there.  Nor was I a member of the jury.  But on this I can say with confidence, unless We the People start treating each other with courtesy, consideration and respect we will see an escalation of these kinds of confrontations.  As a more "in your face" kind of nation it goes with the territory.

I once had a conversation with a reporter 5 years ago from Billboard magazine and we were discussing the gun violence in the inner cities of the US and Canada.  And what we both agree on is this (He is a White Canadian and I am a Black American):


-If a male carries a gun (illegally or for no good reason) he will find some reason to pull that gun, if no reason exists-he will make it up


-Making laws that ENCOURAGE people to shoot people instead of the 200 year tradition we have had in America-which is to NOT escalate a situation which leads to people NOT killing people over nothing


Unfortunately, there will be more of these killings if we don't wake up, and it won't be confined to Black kids

It would appear in Florida, at least according to these "jurors" if you shoot at someone and miss, you are guilty of attempted murder, but if you actually kill them it is OK...no murder, no manslaughter.  The lesson:  Never miss in Florida when you decide to shoot.   Loud music or not, this teen would still be alive today if Dunn did not have a gun and showed some semblance of

tolerance and self control.  Dunn is a killer and the State of Florida made it legal for him to be.

The prosecutor made a huge blunder.  Had the charge been second degree murder, the jury would have deliberated for 30 minutes, not 30 hours.

The jury was allowed to consider 2nd Degree Murder if they weren't comfortable with 1st Degree.  How in the world were they allowed to be comfortable with convicting Attempted 2nd Degree Murder on everyone else in the car, but not comfortable with 2nd Degree Murder for the one that he did kill.
