The 13-year-old girl declared brain dead after a routine surgery is in “bad shape” after she was transferred from a California hospital to an undisclosed location, her family’s lawyer said Monday.

After court battles that drew national attention and eerie echoes of the 1990s case of Terri Schiavo, Jahi McMath’s family arranged to have her transferred Sunday night from a hospital that wanted to remove her ventilator to an undisclosed location, the Associated Press reports. A judge had ordered Jahi be taken off the ventilator by Jan. 7 unless her family found new care for her. Multiple doctors have said she is brain dead without chance of recovery, but the family has so far refused to give up hope.

“We don’t think she’s dead,’’ said family attorney Christopher Dolan, according to the AP. ‘‘We got all the necessary legal paperwork in order to get Jahi out of there.’’

Jahi’s family hasn’t yet released information about her continued care.

‘‘We are very relieved she got safely to where she needed to be,’’ Dolan said. ‘‘She’s in very bad shape. You would be too, if you hadn’t had nutrition in 26 days and were a sick little girl to begin with.’’

At this time, I feel that the parents should cut her loose. I know it'd be really hard, but she's brain dead... She won't wake up. More than likely can't even think, however if her brain works at all I bet she can feel pain and hunger just like a baby. Let her rest in peace. And maybe donate her organs to try to save other people's lives if they're usable... Live on through her memories and in other bodies that may desperately need it.

Usually when you are brain dead you are in "Bad shape". This is inspired by the show "Walking Dead".

She is brain dead. No brain waves. Dead. There is no such thing as bad shape when you are deceased, because everything is now over. It would be nice if some of these dumb judges ordering this stuff would take a science course or two.

At this point her parents should be charged with child abuse, endangerment, and neglect.

Here's the deal, give the parents all the information you can and then it is up to them to make the decision.  Period.  To get a court order to kill someone they believe is still alive is barbaric.  To deny nutrition, fluids, etc. to a living organism is barbaric.  Whether she is brain dead or not the body is still functioning and no one has any way of knowing what she is feeling or what is going on in her mind.  Maybe it is empty and she isn't there anymore, but maybe she is still somewhat aware.  When we begin to allow the hospitals to make these calls we give up everything because it will ALWAYS come down to money.

@BillD I don't understand why you think her parents should be charged with child abuse etc when it's the hospital who had withheld nutrition for 26 days before her family could move her.   Surely the hospital should be charged with abuse and neglect.   Her parents want to give her every opportunity to recover, that's not neglect, that's love.

@jedi2814 Barbaric? To whom? She's brain dead. There is no one home. Elvis has left the building. She's not feeling anything and nothing is going through her mind, because her mind is dead. Everything which made her a person is dead. She's a piece of meat kept fresh by machines.

So who's the court being barbaric to?

@jedi2814 Her parents do have the "right" in the strict sense to do what they're doing, but others certainly have the right to call it irrational and even inhumane. Her body is literally putrefying, for God's sake!

How can she be "still somewhere aware" when she's lost not only higher brain function, but even the brain stem that controls breathing, heartbeat and reflexes? This is a horrible, heartbreaking situation no one should ever have to face, and does point up how relatively primitive medicine still is. But that's no reason to hang on to false hope when the poor girl's corpse has already begun to decay.

@Jimmy_Calhoun   "her body is literally putrefying" ... absolute rubbish - with adequate nutrition (which the oh so caring medical profession is withholding), and basic care, her body will be fine for a long time.   How long was Ariel Sharon in a coma??   Years.  The only difference between this wee girl and Ariel Sharon is money - her parents should not be forced into any decision, and I certainly would not trust anyone who tried to kill my child by withholding basic nutrition.   Any parent who did this would be in jail for attempted murder.

Yeah, there is when there is no hope! The costs must be astronomical, and it is obvious the parents don't have the means for this "million dollar plus" cost.

So who's paying? I AM, YOU ARE! Now I don't mind my taxes being used to save a life, especially a child, but I'd much rather my money be spent helping those who CAN be helped.

Think if all those tax dollars being spent to keep a brain dead child alive were to be given to St. Jude's Children's Hospital where the money could really do some good for those stricken children who still think, and feel, and have hope!

@DonnaRodgers@Jimmy_CalhounI'm sorry, but you are wrong. Ariel Sharon was not brain dead. He was in a coma. She can never wake up because she has no brain function. You don't give food to a dead person. It would be like removing a deceased person from the grave and then begin giving fluids and nutrition.

@DonnaRodgers @Jimmy_Calhoun Incorrect, she is without brain function you do not wake up from that, her brain is broken and we cannot fix that at this point in time. A person in a coma has brain function.

As some one else said she does not even have brain stem activity, the only thing keeping her body alive are the machines.

@BenKasey @DonnaRodgers@killerdrgnFrom what I understand, the family is still accepting "donations" from the public to keep the heart beating inside the corpse. It's beyond my comprehension how anyone could do this to the body of a child they claim to love and adore. In an early news session with the media, the mother said she realized her child had died but that she believed in divine intervention and was waiting for a miracle. I believe she simply wanted to get the dead body away from the hospital so an autopsy could not be done, therefore her claims that the hospital was responsible for the child's death could not be proved to be false. The mother also said she was given instructions that the child should not talk or eat. She, and the child's grandmother,  gave the child a popsicle anyway.
