A long-term care facility has agreed to accept a 13-year-old girl who has been declared brain dead but whose family wants her kept alive, the family’s lawyer said.

A California judge ruled earlier this week that Children’s Hospital Oakland can take the girl, Jahi McMath, off of life support at 5 p.m. on Monday unless an appeal is filed or a new care facility is found. After a undergoing tonsil surgery to treat sleep apnea on Dec. 9, McMath awoke from the operation and began bleeding heavily from the mouth and went into cardiac arrest. She was declared brain dead on Dec. 12, the Associated Press reports.

In order to be transferred to the nursing facility, McMath needs to have a breathing tube and feeding tube inserted, procedures the hospital had thus far refused to perform.
