Police Fire on Van Full of Kids After Traffic Stop Gone Wrong

Oriana Ferrell led police on a high speed chase that ended after the shots were fired

Dashboard camera video shows a Tennessee woman and her 14-year-old son fighting with police during a traffic stop that turned into a high speed chase in October. The video was released by KRQE on Friday and has since gone viral.

Oriana Ferrell  and her five children, ages 6 to 18, were reportedly going on an educational trip in New Mexico when she was pulled over for  driving 71 mph in a 55 mph zone, according to court documents.  When she was initially pulled over, the 39-year-old sped off.  She was later pulled over again, at which time she and her son can be seen getting physical with the officer.

In a newly released dashboard video, police can be seen firing shots on the van as Ferrell sped off again. Ferrell eventually stopped the car in front of a hotel and was arrested and charged with intentional child abuse, fleeing and possession of drug paraphernalia. Her son was charged with battery of an officer.

The names of the officers involved have not been released, though New Mexico State Police Chief said they will be conducting an internal investigation.

This women is a horrible mother. I'm certainly not a fan of the police bt he couldn't of been any nicer for a cop ... She was a lunatic she put her children in harms way over n over n over who does that.. Animal...

She evaded the police by not turning off her engine with the initial pull over.  She chose to drive off and be pulled over a second time and then after getting out of the car she tried to get back into the car.  If she wanted to keep her children calm, she should have turned off the car and explained she got pulled over for speeding which may or may not get her a ticket.  Then explain that the ticket is a form of punishment for speeding and adults can get punished if they do something wrong.  Her behavior and evading the police made her the felon and that was her choice.

It was a freaking traffic ticket !! She was upset - the police assisted her into become a felon. These officers should be better trained to deal with the public. The other officers should be sited as well for not arresting that nut bag with the gun on the spot. Glad to hear he has been fired  (with pay I am sure) for the next 2 or 3 years waiting appeal. They could have even mailed her the speeding ticket!! Way to much cop testosterone.

If the cops are pulling you over and you evade they will chase you.  If you do not follow directions and resist they will keep pushing to capture you.  If you are in a car they will break your windows to get you and if you run into a house they will kick in your door.  You can also end up getting shot at or shot.  This is common sense...what else do you expect.  If I get pulled over with my kid in my car...I am going to work with the cops to protect my child.  This is because I know the police are not to be played with. The cops are no joke and they do not back down.  The police did their job but this mother failed at hers.

"she was pulled over for  driving 71 mph in a 55 mph zone, according to court documents.  When she was initially pulled over, the 39-year-old sped off". ( This is the reason the police approached the vehicle the way they did when she pulled over again after an attempt to evade).  You have to ask yourself why would any "parent" regardless of race, put these children in such danger just to avoid a traffic ticket.

This kind of absolute disregard for the children in the vehicle would lead one to believe that the driver of the vehicle was attempting to avoid more serious charges. It is not unreasonable for an officer to assume that this was a possible kidnapping situation when she speed off during the original pull over for a simple traffic violation. From reading the article it sounds like she did have a reason to try to evade the police. " . Ferrell eventually stopped the car in front of a hotel and was arrested and charged with intentional child abuse, fleeing and possession of drug paraphernalia.

possession of drug paraphernalia, could this have been the reason that mom put her children in danger? While most would agree that putting your children in "grave danger" to avoid a possession of drug paraphernalia charge is absurd  Unfortunately it is the only reason she had that would explain her actions to avoid a traffic ticket.

Do the cops always do the right thing? We all have reason to believe that in some cases the police clearly do not do the right thing. In my opinion under the circumstances and regardless of race, the police acted in a manner that was escalated by the mother.

Pigs will be pigs...It's really not their fault though, after all, the family was driving while black. And why even become a cop if you can't get away with shooting at a van full of unarmed children? The real victims here are obviously those poor poor police officers who were only trying to brutalize a black woman in front of her children. I don't think I want to live in a country where the police can't attack anyone they pull over for a moving violation without fear of being placed on paid leave for a week.

After the lady took off then pulled over again, the officer should have yanked her out of the van and put her on the pavement and cuffed her. She is just as much at fault as the one officer for putting the kids in danger. The cop should not have fired his weapon, but I believe he was aiming for the tire to immobilize the vehicle to keep from putting the children in danger. The son, I would have tased his ass. That cop was very much understanding. The window thing, that 14 year old "BIG kid who tried to take the cop on" cough felony cough, was on the other side of the window. Are there bullet holes in the van? I haven't seen any pics.

"Yes, Sir, I was driving a little fast.  I'll watch my speed more closely.  Can I handle this by mail?"

While the cops reaction was wrong, Mom has only herself to blame for this one.  Had she politely complied with the officer's request (shut off the engine) and waited patiently for the ticket, that may or may not have come, we wouldn't be reading this.

For all we know, as long as her tags didn't come back with some sort of flag (no insurance, etc), he might have simply cautioned her to drive more carefully (there are kids in the car, after all) and enjoy her time in New Mexico.

Totally on her.

Rule 101# for escaping a kidnapping attempt is to resist immediately and try to create a PUBLIC OUTCRY.  This woman managed to get her children to a PUBLIC place before finally submitting. Well done. THE WORLD IS WATCHING!

LaffingCrow

I think this started as a simple misunderstanding and instead of calmly assessing why she drove off (she did pull back over), he escalated the situation.  You could tell that he had let his anger get the better of him by the way he marched up, yanked the car door open and began screaming at the occupants. He was aggressive and confrontational and was the reason everything spiraled out of control. When he lost control of himself, he also lost control of the situation.

Faced with being arrested in front of her five children, mom panicked and did the wrong thing. Her 14 yr. old son, of course, tried to help his mom and while trying to do the right thing, he also ended up doing the exact wrong thing. It all started with the police officer however, the professional who supposedly was trained to avoid escalating these types of situations.

Whatever the mother and her children did, the attempt by the police officer to break the window pane (what if a splinter of glass had hit one of the kids in the eye?) and the indiscriminate firing at the departing vehicle full of children (with the distinct possibility of one of the bullets hitting one of the kids inside or another bullet ricocheting off and hitting an innocent bystander on the road) was grievously wrong. Correct as the arrest of the mother and the 14 yr old son is, the police officers must be punished for their brutal behaviour. Looking at the first officer roughly pulling at the mother's hand to prevent her from getting back into the car is appalling and scary as well. Such law officers remind us of the worst excesses of a police state. How is this different from fascist behaviour?

Let's talk about the scumbag mother and son that didn't give a sh*t about the other kids in the car!!!

The article says Ferrell and her 14 year old son became physical with the police?!  What sort of crap comment is this by a journalist?  The police pulled guns on the 14 year old, who was unarmed.  The police broke the window of the car, with children behind the window.  They even fired bullets at the car!!!  What sort of imbeciles have become police?  They could have handled this far better by calling for back up and following the vehicle.   This is yet another example of America become an unconstitutional police state.  Outrageous police behavior.

If these police escape unpunished we will have myriad deaths of innocent civilians as a result.

Firing at a van full of kids? beating out the window with a baton? And we wonder why the world laughs at us when we criticize them for human rights........

Was it necessary to start firing rounds into a van full of kids?? excessive force... maybe??

I guess this is what a police state would be like.

The 14 year old looked older and acted older,he is very lucky to be alive. The mother is and was very stupid ,she placed her kids in jeopardy, almost got one son killed. Very much the typical big mouth black woman. The officer who fired at the car as she was driving off for the 2nd time should be terminated, he was not justified in firing shots at a vehicle that was be driven away and not being used as a threat. He knew there were kids in the vehicle.. The other officers involved were justified. This woman was without  a doubt wrong and belligerent and deserved to be arrested as did her thug son. a stupid family almost tragic.

@Inmyopinion so shooting at a van full of kids was, under these circumstances, was justified....?

@johnyk  Unbelievable, you are congratulating this woman for getting her children to a safe "public" place before submitting. You believe that she saved her children from a kidnapping attempt by the police!  It is obvious you have replied based solely on the information you were shown in the video.

Had you taken the time to read the article you would have found the reason that police reacted in the way they did.

Mom chose to lead the police on a high speed chase not once but twice, putting her children in grave danger because she had illegal drug paraphernalia in her vehicle.  There was no other reasonable explanation for her actions. Dont take my word for it, go ahead and read the article. You might want to edit that "well done" comment to the mother once you have.

johnyk
johnyk

@RobertaMetalious And you know the mother and child are "scumbags" because....? Why do you think they are scum?

maybe the Mother had some premonition  about what kind of cops these were eh? Seems like she was scared.. but if she was she had good instincts.. because the cops then acted like psychos!!!!!

One cop starts smashing in the windows with no respect for the safety of the innocent children inside and another fires wildly at the car.

Who know what they would have done if she had not managed to get to a well lit public place?

Reminiscent of how the Guatemalan Snatch Squads operate. true patriotic Americans take heed. The price of Freedom is Eternal Vigilance!

@saneandeducated So obviously a TROLL. you claim to be a Black ex-police officer? Then say "Typical Back woman with a big mouth?" So the correct response if I understand you correctly is to shoot at a car full of kids?  Are these going to be "typical" black kids so it is OK to shoot at them?

You are so obviously a racist that i want to leave the issue of race to one side for a moment. Is it OK for Police of any race to shoot at a car full of children (of any colour). To smash the windows of a car full of children?

As the video makes clear this policeman was no great marksman.. he failed to hit the van (thank god!).  What if hypothetically speaking, one of his reckless shots had hit your mother? Presumably she is also a typical loudmouth black woman? So would that have been OK?

DarwinAkbar

@DealBreaker  The cop was trying to shoot out the tires. What better method would you suggest to try to stop a vehicle getting away? It would be much more dangerous to run a vehicle off the road when it is in motion. The cop tried to stop them from driving off but failed.

relcontrario
relcontrario

@Openminded1 You are a racist bigot and fool, and even you admit the police were imbeciles.  This shows the pathetic level of intelligence of these police.  If they escape unpunished, America is a police state.

Inmyopinion
Inmyopinion

@schwabin @Inmyopinion If you are talking about the failed attempt by the cop to shoot the tire of the vehicle? Shooting at the tire was an effort to prevent the driver from yet another high speed chase.

A high speed chase that could have killed all of the kids in the vehicle, along with any innocent victims that may have had the misfortune to be on the same road during this chase.

The cop had two options and only a matter of a few seconds to make a decision.

#1 shoot at the tire and disable the vehicle and prevent a high speed chase, with the chance of a poor shot or stray bullet injuring or even killing one of the kids in the van.

#2 is what you would have preferred the cop to do, and that is to do nothing. Just allow the driver of the vehicle to endanger the lives of all of the kids and any other person on the road that might fall victim to this chase ending in some horrible wreck.

More often than not these high speed chases end in injury and in many cases death.

So in my opinion yes, I believe that the chance of multiple injury or death would be more likely if the driver was allowed to enter into a second high speed chase. The chance of a stray bullet injuring or killing one of the kids in the vehicle was less likely.

The police are out of control and continue to violate our rights on a regular basis. We have seen them act with blatant disregard for our safety as if they were not aware that we are paying them to keep us safe.

With the information I have been provided it is my opinion that the police acted in a reasonable manner given the severity of the situation.  If you have done nothing more than watch the portion of the video that the media has chosen for entertainment reasons to show the public, Ten it is understandable that you would assume that the police are overreacting to the situation.

Some times you have to let them get away to save lives. Gunfire and a high speed chase after a traffic stop is totally ridiculous. Not only did the cops put the kids in jeopardy, but also the general public.

Dummy i did not say the police were imbeciles. I said the one officer that fired at the vehicle was wrong. All the other officers were right. You are not to bright, the woman and her son where the ones who started the problem. You do what police officers lawfully tell you to do. You do not attack police officers, do not run from the police. that is  everything this stupid woman did , plus put her kids in danger. her 14 year old punk son was way out of line. most 14 year old kids do not attack policemen, unless they are thugs. Now another lesson for you. I am a 30 year police veteran and I am Black man so you jump to conclusions that where wrong. I stated the one officer was wrong not all of them. The mother was the real problem. next time read and comprehend. And do not use the race card. blacks are racist too, even more then whites and you are hearing that from a 63 year old retired cop.

"i am black and i know black women"

That's odd, on another thread you claim to be "italian". Sometimes it's half black/ half italian. I guess it depends on whether or not you need to defend your bigotry by claiming to a member of the group your bigoted against.

And you claim to be "a cop", but you don't talk like a cop, and your knowledge of police procedures sounds like it was taken from an 80s action film.

What we have here, ladies and gents, is a sad little man trying to play Tough Guy on the Internet. Let's not feed his delusions or satisfy his dark desires for interaction by continuing to engage him. He's a fraud.

@relcontrario the dummy is you a normal kid with common sense would not attack a police officer.  Only a dummy would. He did because of the way he was raised, by a mom who did not care about the the law and breaks rules , good example of a parent. no wonder her punk son attacked a cop.

Openminded1

@johnyk @Openminded1 You live in a country where most people do not have guns dummy . here a. cop never knows who he is stopping and what the person has in a car.so in your bleeding heart mind it is ok to disobey a policemens order, and drive of not once but try it twice. The officer moron stopped her for speeding' All the big mouth women had to do is comply with the lawful stop. maybe In England you do not do what police tell you to do, but here if you dont you can get arrested. It is simple dummy. If she had just done what she was told shut off her engine. Comply with the officers request she would not have been arrested and her punk son would not have been arrested, and she would not have placed her other kids in harms way. The cop that fired on them was the only cop who was wrong and will pay for that. thank god no was shot. But it was the big mouth stupid women who started the chain reaction and was wrong, not the cop that stopped her. The back up officer who fired was also wrong look at the video and read moron. This is not  England, you are not the size of the USA nor do you have the weapons on the streets we have. You also do not have the same black attitudes we have as black officer I know blacks, they escalate problems here.

@Openminded1 "most 14yr old kids do not attack policemen unless they are thugs"?

Would most 14 yr old sons try and defend their mothers from violent attack by strange men in uniform using insanely inappropriate levels of aggression?

I like to think mine would. Fortunately my son lives in England, where the phenomenon of  Policemen acting like Terrorists is, as yet unknown territory.

And OPENMINDED your Comment was "should have shot the kid that got out of the car"

@LaffingCrow @Openminded1 You are either a black race card moron, a bleeding heart liberal or just plain stupid. read my post dumbo , I said the cop  who fired his weapon was wrong and should be punished, do you not read well. The other cops were within their rights and training and did not do anything wrong. Only one cop fired. The woman on the other hand was very stupid and a typical black woman with a big mouth who put her kids at risk by defying the police officers and driving off. Not just once did she defy them but twice. her punk of a son attacked a police officer which is a felony. They should have been arrested and the cop should be terminated that is what I said moron read my first post.  She does not deserve the benefit of the doubt, women kill people too dummy, how is a cop suppose to know what she was thinking or if she had a gun or even if those where her kids. She was the one who was wrong, she started  it. All she had to do is comply with the officers wishes and the worst would have been a ticket. but she decided she does not have to do what the police say, because I am a black woman and the President is Black and Al sharpton will come to my defense and I can sue and make easy money and use the race card. I am retired now for 11 years and 63 years old I have no aggression  I am just sick of the race card crap that I know as  a black and ex cop is bs.

@Openminded1Whatever happened to "Protect and Serve"?  I thought police were professionals, who were trained not to escalate a situation like this. Did it ever occur to you that since he was talking to the driver from the passenger side window, that she might have misunderstood him? That maybe, because she was a mom with five kids in the car, she should be given the benefit of the doubt and calmly asked why she pulled away earlier, instead of instantly being treated like a criminal? No I'm sure none of this occurred to you. Your posts make it evident that you are a very aggressive and angry man. It doesn't surprise me in the least that you are a retired cop. Of course you are defending this sorry excuse of a cop's actions. You are him.

@relcontrario @Openminded1 The boy has you call him attacked a policeman, that is a felony. If his stupid mom at complied and did not speed off after the officer told her to shut off the engine, none of what occurred would have happened.Cause and effect. protecting his mom from a policeman no excuse, unless the cop was breaking the law. Which he was not. She did not comply with a police officers order. You are the one doing the twisting of evidence , it was clear on the video moron. You better not react the same way if stopped by the police, or you will be on your way to jail. You are clearly the racist with a double standard. If they were black cops would you be saying the same thing i doubt it.

@relcontrario Jack ass I am black with over 6000 post on here,go back and check a few dummy. I am also a retired cop and a realist, not racist. You use the race card like most blacks, you just fine it hard to believe a black man would say  something negative about a black. I know police procedure after 30 years of being a policeman.
