A Connecticut judge will decide Wednesday morning whether Michael Skakel will be released on bail as he awaits a new trial for the 1975 slaying of Martha Moxley.

Skakel was convicted of the murder in 2002, but Judge Thomas Bishop ordered a new trial last month, saying that Skakel’s attorney Michael Sherman did not adequately defend him at the original trial, the Associated Press reports. Skakel and Moxley were neighbors in Greenwich, CT, and she was found bludgeoned with a golf club after attending a party at his house.

The case drew national attention because Skakel is the nephew of Robert F. Kennedy’s widow, Ethel Kennedy.
