Sentence Shock: Just 30 Days For Teacher Who Raped Student

A judge suspended the rest of the 15-year sentence in the rape of a student who later committed suicide

A Montana teacher convicted of raping a 14-year-old student who later committed suicide will serve just 30 days in prison after a judge suspended almost his entire 15-year sentence.

The student’s mother, who had previously testified that the rape was a “major factor” in her daughter Cherice Morales’s suicide, repeatedly screamed “you people suck!” during sentencing on Monday before storming out, the Billings Gazette reports.

The teacher, Stacey Dean Rambold, was charged in 2008 with three counts of sexual intercourse without consent. He pleaded guilty to one count, but the case was complicated by the girl’s suicide just weeks before her 17th birthday. Rambold was ordered to complete a sex-offender treatment program to have the charges dismissed, but prosecutors revived the case when they learned he had been terminated from the program.

The judge, who said Morales was “as much in control of the situation” as Rambold, said that the teacher’s termination from the program did not warrant the lengthy imprisonment. He suspended all but 31 days of the 15-year sentence — and gave Rambold credit for one day already served.

No one has the right to say a person cannot engage in sex. Statutory rape laws are unconstitutional.

I find this ironic as my brother - a youth pastor in Massachussetts - was sentenced to 3 years and 1 day in prison for "hugging" and "putting his hands on the shoulders" of teens in his youth group.  This country has some jack-up justice at work (or not at work).

Finally, payback time.  After the dozens of female teachers having sex with underage boys (yes, as young as 14) and getting ridiculous slaps on the wrist, a judge returns the favor. When these crazy women stop taking male students' innocence from them and breaking the law, one after the other, it'll be time to punish male teachers like before.

This case is very clear. The girl was under 18. That makes it statutory. Consent or not. How many women teachers have gone to jail for having sex with their minor students?

The racist, ammoral, sparked-to-get-a-reaction sexual comments made by one individual should be ignored by everyone.  You are only feeding his small ego and limited ability for intelligent conversation by responding to his attacks on everyone who disagrees with his vitriol.  Don't degredate yourselves to his level or give him any more reason to post.  

For a moment, consider this was your fourteen year old daughter with possible mental disorders and insecurities.  Would you not feel a little differently if this was closer to home?   None of us know the complete truth, only what the media puts in print or televises.  Most of what media reports is skewed, misrepresentations of whatever event happened.  It is sensationalized fodder for ratings.  The point I would like to make is, why would a teacher want to have sex with a student who was of an illegal consensually sexual age?  He is by all definitions a sexual predator, and should have either served time or gone through far more counseling than he has.  And who will the outrage be for when he commits another sexual crime?

where is the outrage on the 18 year old lesbo (possibly with her mothers help) doing it with the 14 year old girl while on bail and restrictions.  Thank goodness the judge revoked and put her in jail pending trail.  Why do people think its OK to nail guys but not girls and when girls get caught doing perverted things like Kristel Ball the girls say they are exposed because of sexists men and a double standard.  Look at the Ball's pics and who is acting as a perverted sexists.

This was a case of STATUTORY rape.  Unfortunately the Gazette doesn't make that clear.  Age of consent in MT is 16 years, so technically the girl couldn't consent per the law, but it's clear from the rest of the story that has come out over the years that she did consent.  They had a relationship for some time.  Keep in mind that it wasn't until the criminal charges were brought that the girl committed suicide.  That doesn't make it right, obviously the guy should have known that you can't have sex with a 14 year old, but I don't think it's fair to lump this in with all the other cases of rape, which are usually brutal, physical assaults.

ok... how about this.... everyones bitching here.... but what about being helpful towards the girl?  she was depressed wehres the people saying lets take care of the children so they dont feel so lost?  no its lets kill people yea wooo... hang them caus killing is fun and fixes everything... maybe thats the reason this world is screwed up?  how about lets go with saying, people should have been thier to tend to the girl not every second of the day but atleast enough to value you and help her feel valued?  for her, and for every kid, person and even teens? twenty year olds? thirty year olds?  everyone of every age and beyond?  just a thought... based on general human desires to be valued

I'm sure the judge gave the sentence he did with good reason, although I don't condone sex with minors. But, she could not have consented to sex if she was a minor, by law.

 She was obviously asking for it. I'm sure she was a huge sl*t before he banged her and she totally consented. Yes, it was statutory rape but she was no innocent victim. Just another teenage sl*t. It's not like he's raping babies and 6 year to 10 year olds, that would be disgusting. I'm actually ok with what this guy did. I'm 21 and I never would though because I'm not stupid but I saw pictures of the girl and she looked like jailbait trash too. I'm glad she offed herself. And on that note, I highly doubt she killed herself over this. The fact that she was obviously having alot of sex with different men at 14 shows she had some serious mental problems before any of this. I'm sure she had plenty of experience with sex before this teacher came along, hell she probably enticed and seduced him. Teenage girls are such depraved wh*res these days I honestly wouldn't be surprised in the least...

@MauriceAdelmon Not true. Some instances were consensual, but not all. Still, are we forgetting the Montana laws for statuatory rape? "Life imprisonment or between two and 100 years. If the victim if under age 16 and the offender is at least three years older, life imprisonment or four to 100 years." Doesn't sound like thirty days in jail to me.

it was without consent not with consent, which is why she committed suicide.

as for myself, first time I had sex I was 13, she was 19, I was raped according to the law, but I cried because when she dumped me the next week.... just because you're young doesn't mean you can't be in love or ready (and eager) for sex.

@JohnHurd What on Earth are you talking about?!  You obviously steer clear of actual news and either flat out make things up or use data from 20+ years ago.....  I see more stores about female teachers being arrested / jailed for rape than I do any other form of rape (other than stories from foreign countries).

@JohnHurdJohnTurd,  You are a sick.  Did you read that the victim killed herself?   She is dead at 17.  Go ahead and pretend that there is no such thing as gender and that men and women are the same.  Go ahead and gloat that this man raped that girl and now she is dead and her mother has no child.   Men rape far more often and more violently.   They even rape males more.   Men kill more often when they rape too.   Pretend that women are worse though.  Pretend that a few well publicized cases are more important than thousands and thousands of cases of male on female rape or even male on male rape.  It makes you feel better somehow so go with it.

@opsec Krystal Ball (who I'm going to assume you were referring to there, since I don't get any other results) was a consenting adult who was doing something with her husband, also a consenting adult. And I will admit to not knowing anything about the other case, but there's going to be a trial, which is good. But in this story, there was a teacher who had sex with a fourteen year old. And the legal system is letting him get away with the excuse 'she's older in spirit'? There's a reason for minimum ages of consent, and we can't start bending those rules. Minimum sentence in this kind of thing, as far as I could find, is supposed to be four years. So dropping it to one month is a slap in the face.

@mtdude88 rape in reality is not like the ones you see on TV. The stereotype of a stranger in the night brutally attacking you is wrong. According to US Bureau of Justice, about 71% of rapes are committed by a person  the victim knows. Consent is not not getting a no. Consent is about a person being able to say yes saying yes. And a fourteen year old is not legally able to say yes to sex according to the state of Montana. Rape is rape, and trying to quantify whose experience was worse is horrifying.

@Randysteele992  - Seriously what is wrong with you?? I think you need to seek counseling for your anger issues towards females. This 14 year old girl might have been troubled and promiscuous as you suggest, although none of that is mentioned in this article. Even if that is the case, all the more reason for the adult in this situation to step back and tell her parents or the authorities if she was trying to seduce him rather than take advantage of her mental state.

@jwmagathan @AlPa    He's an immature scumbag..BUT there IS a difference between a brutal non-consensual rape   and sex between an adult male and an underage teen that IS consensual...aka STATUTORY RAPE...  if you think there's NO DIFFERENCE, which would you rather have?   

It's bizarre that people don't see any differences and it's dishonest to keep calling it just RAPE, when it's STATUTORY RAPE...and there is a significant and important difference.
