Squealing SEAL: No Surprise Here

A SEAL in training.

The Pentagon’s top lawyer wrote a terse letter Thursday to “Mark Owen” – Jeh Johnson fastidiously put the author’s pseudonym in quotes – warning that “Owen” is in legal jeopardy for penning No East Day: The Firsthand Account of the Mission That Killed Osama Bin Laden without the allegedly-required prior approval from the U.S. military.

The one-page missive, which politely begins “Dear `Mr. Owen,’” was sent to the attention of Alexander Gigante, the lawyer for the publisher, Penguin Putnam. The book is to be formally released next Tuesday, Sept. 4. Even if the Defense Department concludes the author disclosed no classified information, he could face charges that he failed to submit the manuscript to the government for review prior to publication as required.

Johnson informs “Owen” that he has violated a pair of non-disclosure agreements he purportedly signed on Jan. 24, 2007. “You have a continuing obligation to `never divulge’ classified information,” Johnson writes, “and this commitment remains in force even after you left active duty Navy.” Johnson adds that “Owen” reaffirmed this commitment when he was debriefed upon leaving the service in April.

“In the judgment of the Department of Defense, you are in material breach and violation of the non-disclosure agreements that you signed,” Johnson adds. “I write to formally advise you of your material breach and violation of your agreements, and to inform you that the Department is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation.”

So there you have it. “Mark Owen” – actual name Matt Bissonnette – apparently did give his word that he wouldn’t spill his guts. He violated that sworn pledge, and now he needs to pay the piper. Otherwise, anarchy.

As an attorney, I watch the No Easy Day drama

on the sidelines. The general public is unfortunately misled about military

confidentiality and non-disclosure. The ebook entitled “NO EASY DAY for MARK

OWEN: The Legal Brief,”  sets the record

straight. (http://www.amazon.com/Easy-Day... I review the legal arguments for both the Government and Mark

Owen, showing why the government can’t go after him. Executive Order 12356 is

crucial to the analysis. I have also written another ebook entitled “NO EASY

DAY: A Fictional Account of the Mission that "Killed" Osama Bin

Laden" (http://www.barnesandnoble.com/.... That one is total fiction published May 9, 2011.

I don't want to say that the integrity of the whole nation has become distorted by our celebrity saturated culture, but there is another book coming out right after this one by the German Shepard SEAL team member: "No Yummy Day: How My Team of Slow and Clumsy Humans Helped Me Corner and Kill the Tall Man--and yet no extra dogie-treats at the end of my Rin Tin Tin-like day!"

Interesting. I had a similar debrief when I got out. I had thought about writing about some of my adventures, but ended up deciding that it would be too difficult to make interesting with what I would have to cut out.

I don't condone what he did and think it's pretty low-class to cut and run for profit as he did.

This book was underwritten for political purposes - "swift boating" on steroids - with the "high value" target a sitting president up for re-election.  A typical publicists' ploy was used to sell books - the old "didn't happen" that way - giving media talking heads something with which to fill airways, figuring on making a lot of money off those who fall for it!

It has Karl Rove's fingerprints all over it.  The attorney representing Matt Bissonnette - Robert Luskin of Patton amp; Boggs replied to the DOD Gen. Counsel - is also Karl Rove's personal attorney who represented Rove during the Valeried Plame investigation.  You can bet the farm that the attorney-lobbyists at Patton amp; Boggs firm don't come cheap!!

Karl amp; The Boys are experts at running red herrings like this one, getting everyone to chase some non-issue such as not going through proper procedures to vet the book first.  Y'all are doing a fine job of chasing, too!

Good Job Time. The book is called No Easy Day. Not "No East Day". No Offence but please get your facts straight.

If you believe everything the Government tells you then you are totally clueless. Our Government does things the American Public will never find out about. But for the Obama Administration to give a classified briefing on the raid to a coked out Hollywood Producer that's a slap in every veterans face. More people vote on American Idol than the Presidential race that's pathetic. Obama said he was going to clean up Wall Street guess what a TARP 2 is coming soon !

To the clueless liberal who commented on my post : The Obama inner circle leaked very classified information that can endanger our troops lives. What about the leak in regards to a Tuesday Kill list ? What about telling the world that the USA along with Israel created the Stuxnet virus that infected the computers of Iran slowing down their nucluer growth. If this ST6 member have not written his book another member of the raid would have. This guy had 10 deployments High Risk missions - ten years of service but no retirement. He set the story straight instead of the lies the White house spread an I'm sure your a big fan of Joe Biden lol. Have you served ? Of course not so your in no position to comment on a subject that you are clueless about :)

Have you read the book?

Marky82ndABNRECON

Yeah matter of fact I have read the book no classified info was leaked. The only leaks came from the Oval Office like DEVGRU no one in the public knew of this unit it was classified an to advertise their home base in the States so some radical Jihadist can drive a explosive laden truck into the Base ? And the make believe story the White House created : Bin-Laden poked out his head they fired a few rounds , missed . Then they entered the room shot a women in the leg the one operator eye to eye double tapped him?  First these guys don't miss , this is the same unit that nailed 3 bad guys who took the American Captain hostage in the head at the same time at night while the boat was bobbing up an down. Their budget for ammo for training is more than the entire Marine Corp. I have never seen in my life the Politics intertwined with our Military as it is today. Every Soldier is entitled to their opinion they might not like the Commander in Chief but they go out an do their job. This team has did 100's of raids on High Value Targets these guys are cutting edge along with the Combat Applications Group of the Army. They risk their lives daily on high risk adventures an the pay is not the greatest.

I guess you've never heard of Wikipedia then - with a lengthy list of articles amp; books about SEAL Team Six operations in the Notes section, including this one: Smith, Michael (2007). Killer Elite: The Inside Story of America's Most Secret Special Operations Team. New York, New York: St. Martin's Press.

ThumperNM

You have read a book not yet released? I say, your full of shit. As a long time SOF asset the existence of Seal Team Six has been published and documented for two decades. Your partisan dishonesty is merely the rantings of a disgruntled wing nut. I signed nondisclosure agreements in 1970 in Viet Nam and through out my military career and have yet to violate that promise. Bissionette has put a bulls eye on the families of his former team mates and has dishonored his uniform.

Obama and his socialist  anti-american political associates have already released everything that could be considered "classified".   This true American hero is just trying to fill in all the blanks with the facts

An all he had to submit his book to the Pentagon and if there no top secret details  mention in the book then it could be release. This would take months, an may be involve a rewrite or two, but that better than going to prison.

This member of ST6 set the record straight by telling a accurate account of the raid not some drama filled adventure as the White House. Then the White House uses it as a Political Campaign commercial. The White House revealed a Classified  Unit that the general public had no knowledge of and it's home base. The White House also revealed operational tactics that can harm future operations by Tier one units. All of our Presidents attended the Anniversary of D-Day except for one who has missed it every year his name Barack Obama !

If this ST6 member did not write the book another member who was on the same operation would have !

Moms Hugs

You are really naive if you think the general public had no knowledge of SEAL Team Six amp; its home base.  So I guess you've never read all the books amp; articles written about them like "Killer Elite: The Inside Story of America's Most Secret Special Operations Team" by Michael Smith (2007 - St. Martin's Press).  Time to stop drinking whatever it is you're drinking, Marky.

inthemiddle12345

As an ex SEAL, I agree that Matt has screwed the pooch here. That being said, he is only following the example set by the White House. Prosecute Matt Bisonnette, but ONLY after you prosecute the individual within the White House who is simultaneously leaking national security secrets like information about the Stuxnet virus. For that matter, I am still waiting for Patrick Leahey (aka "Leaky Leahey") to be prosecuted for his leaks which directly resulted in the death of a CIA operative. Why in the heck is Jan Schiakowski not in jail for her leaks? We can't have two sts of rules.

Marky82ndABNRECON
Marky82ndABNRECON

He told the truth after the White House spun some dramatic adventure tale then used the raid for their own Political gain. If he didn't write a book another ST6 operator who was on the raid would have. It was okay for the Obama Administration to name ST6 which is classified , their home base. Tactical aspects of the raid which can harm future missions by Tier One Units. He didn't disgrace ST6 the Obama Administration did. Think before you make a comment on a subject matter that you have no idea of !

The timing of the book's release, along with the autor's openly expressed DISDAIN for President Obama, smacks of politically-motivated get-rich opportunism! Other than contradict original reports of how Osama bin Laden was killed, most reviews of the book failed to highlight ground-shaking events or actions. This may make the book tamer than many thought, and since no real classified information was revealed, then the Pentagon can rest easy. The book is directed more towards Obama than Osama and it failed in its goal because Osama was killed on Obama's watch, thus Obama takes the credit. If the raid had gone wrong, Obama - not the SEALs - would have been held responsible, so give credit where and when it is due.

christopher starling
christopher starling

The intention of this book is to take credit away from Obama for Bin Laden's long-awaited death and thereby in support of Romney. . .

which is why the book is being published now, rather than a year from now or after it could be reviewed and approved by appropriate authority. . .

and earlier this week an anonymous comment was made by one of the SEALs, complaing that Obama was going to take credit for Bin Laden's death, something that SEAL wasn't happy about. I wonder who this SEAL was, duuhh.

Everyone of us who worked in or were aware of classified information in the military were sworn to secrecy, divulging classified information of your country at any time is a serious crime and puts not only our fellow military members but our country in jeopardy. To allow this serious breach by an elite member of our armed forces by our government is wrong, this man must be punished because the very nature of this book is classified until the military and government declassify it. It is a slap in the face of all of us who were sworn to secrecy and honored our committment and our sworn statement......

krustypie

Obama is allowed to declassify government information, it one of his powers as president and being commander in chief, some low rank special force guy is not allow to declassify information or talk about his life in the special forces without asking the Pentagon first an have his information vetted.

Anyone think that the whole book was a ploy? The book gets written knowing full well that the pentagon could shut it down? The book is written presenting the personal opinion of an ex-SEAL. Who backed the book? Who paid him to tell the story and who is paying for his lawyer? Where does the money trail really go?

If the pentagon prevents its publishing, it is a "cover-up". If allowed to be published, it's a an indictment of the Obama presidency. It's a right wing wet dream either way.

Or what the GOP likes to call a win-win...

The one that should be really worried is Not this author, been here before did that before with other authors,  SEALs and others, { SEALs have been consultants on movies and drama's for years, SEALs have written books about themselves and ops before, the Pentagon puts out minny docs on SEAL training and ops, and on and on and on}especially as this was a CIA controlled op. The ones that should be thinking what they're doing before they do it, like whoever gave his name and personal information to the FOX and the FOX quickly running with it, mainly because there isn't a professional in the lot just high paid talkin heads, and those who continue using his name, unlike CBS who will be airing the interview with him this Sunday on 60min and have the preview already out. Everytime his name is used it's a breach of National Security, like I said it was a CIA op, and places him and any near him in grave danger, as the already called for retaliation has been put out within days of the FOX outing!!!!!!!!

It's quite funny how a lot of you people are condemning this man who is finally giving the public what they need. Obama is a joke. He claims that we have to have respect for this TERRORIST'S culture, but was that same courtesy given to the men and women who died in 9/11 OR the wars resulting from? This piss-poor excuse for a "President" wouldn't even allow ANY of the families of the victims of 9/11 to even see the body for their own closure or peace of mind. All because we have to follow the rights of a culture that hates Americans just for being American? Wake up, people. You've been lied to and yet you crucify the one person TRYING to tell you the truth. This ST-6 member deserves honors, not jeers from you people who act so tough behind your monitors and iPads. This man is a hero. Not a villain. He risked his neck, tegardless of whether bin Laden was there or not. That's more than you can say about Barrack HUSSEIN Obama.

Sadam had died years before the fake death. The evidence (his body) was said to have been placed in the sea which was convenient. The seals died in a helicopter crash. All the loose ends were tied up and evidence was gone. Looking for someone who wasn't there was the excuse needed to invade countries. It would almost be funny how gullable the worlds public is if it was so sick.

First of all the Commander In Chief has the ability to say anything he sees fit. He does not leak, he speaks. He is not restricted in what he may release. If he wants to send a clear message to the terrorists of this world that "we will find you and kill you, and here is the proof;" he can. The US military can declassify as they want and he is in charge. This may or may not result in less effective missions in the future. A raid is not sneaky after it happens. I guess our enemies know that ST-6 is going to sneak up on them, kill them, and leave... Good. We tell them this as a point of fact. Now the Seal is screwed. He has no authority. He is not the POTUS.

TristramShandy
TristramShandy

The man belongs in prison. Our government works too hard concocting plausible lies and propaganda to have them spoiled by truthful accounts from so eone who actually risked his life in the operation. Here I was, waving my flag, imagining Osama taking one to the forehead as he peered out from behind a human shield to take pot shots at our boys in black. Now some Johnny-come-truthfully tells me they shot an unarmed man of high intelligence value. I can't even revel in nationalist superiority over his low-down hostage-taking, because this "Owens" traitor says he didn't have one.

When will these traitors learn to keep their miuths shut... Unless it males us look cool, like the drone strikes, or it's authorized by the Vice President for purely vindictive political reasons, like Plame.

Knowles2

The only true full account would be the full unedited video of the raid, most if not all of the team members were wearing cameras, only that footage contains the truth, everything else is only one person interpretation of the event, an studies shows that individuals recall the same events in different ways.

Lets not be too brutal. The Military and its members cannot and should not be partisan, whatsoever. He has done wrong in the name of partisanship (to bad-mouth Obama) and he should be persecuted to the full extent of the law. But not to the level of being taken out. Republicans will have a field day if this is to happen....

I don't see what the problem is here.

This is a man raised in a country that openly dictates that War is a business...! So, in the land of the free, why shouldn't a person who works in the same business industry make money like all his superiors, and external military contractors do...?!

This, when you consider he his one of those who actually puts his life in danger to do the bidding of all those corrupt Politicians...! If you ask me, you all need to wake up and accept that honour has been Raped by our politicians, and therefore, its every man for himself...

Obama doesn't care about the military.  Afterwards, Obama then sent the SEAL team six members  on chump missions that got a bunch killed, and then Obama sent form letters with a rubber stamped signature.  Meanwhile he sent a personal note to the family of a hip hop star who passed, but to SEAL team six members families that died in that August 2011 helicopter crash he sent form letters.

The fact is SEAL member who was second in the room when Osama Bin Ladin was killed is a more worthy source of info that anyone.  And his story seems to contradict the official story.  There was no fire fight.

Yeah, Obama and his DOJ uses their political influence to not prosecute the Black Panthers who tried to prevent people from voting, but they go after Navy SEALs for just telling the truth.
